Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
to each of its employees, employment and a place of employment, which was
free from
recognized hazards that are causing or likely to cause death or serious
physical harm to its
employees, in that employees were exposed to being caught between a truck
backing up to the
dock and the dock structure.
On or about February 17, 2002, the bumpers which were installed on the
dock at the
Jewel located at 4 E. Ogden, in Westmont, Illinois, did not allow the
proper insertion
of the dock plate, without having to pull the trailer forward to create a
gap.
Feasible means of abatement include:
(a)  The installation of bumpers which allow for the proper insertion of
the dock plate.
(b)  The installation of powered dockboards and lifts at the dock.
