Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing hazard when the fork lift tipped over: (a) Facility, Route 21, Masontown, PA: On October 13, 2001, an employee sustained serious injury when the forktruck he was operating tipped over. The operator was not wearing a seat belt, which was original equipment on the forktruck, at the time of the accident. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE MEANS TO ABATE THIS CONDITION IS TO TRAIN AND ENFORCE EMPLOYEES TO UTILIZE THE SEAT BELTS THAT ARE EQUIPPED ON THE FORKLIFTS.
