Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause
death or serious physical harm to employees in that employees were exposed
to potential hazardous
atmospheres:
(a) Jobsite, Chartiers Avenue, McKees Rocks, PA: On or about May 1, 2002,
an employee entered a six foot
deep sewer manhole prior to determining that the atmospheric conditions
were safe to enter.
Among other methods, one feasible and acceptable abatement method to
correct these hazards is to conduct
atmospheric testing for the  presence of a toxic gas or explosive
flammable gas or an oxygen deficiency in
accordance with the American National Standards Institute Z117.1 consensus
standards.
