North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)jobsite, employee operating Lull Highlander model 644-B-37 rough terrain forklift was not wearing a seat belt while operating the forklift. NOTE:Among other methods, one feasible and acceptable method to abate this hazard is to enforce the use of the seat belt as referenced through ASME/ANSI B56.6- Safety Standard for Rough Terrain Forklift Trucks.t
