Minn. Stat. 182.653 subd. 2: The employer did not furnish to each employee, conditions of employment and a place of employment free from recognized hazards which caused or were likely to cause death or serious injury to employees: The employer did not ensure that the employee working from the #708 MEC scissors aerial work platform was free from a fall hazard of approximately 12 feet by the use of a personal fall arrest system. The employee was standing on the mid rails of the aerial work platform in order to gain additional height for his overhead inspection. The guardrails of the aerial lift do not offer protection from falls once the employee leaves the platform to position for work at a higher level.
