Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the overturning and/or rolling over of heavy equipment:
(a) On 6/25/2001, an employee suffered fatal injuries when the bulldozer
he was
operating rolled off the edge of a clay storage embankment.
Among other methods, one feasible and acceptable means of abatement would
be to
follow the requirements in MSHA regulations 30 CFR 56.9301 and 30 CFR
56.9304 that
state the following:
30 CFR 56.9301: Dump Site Restraints - Berms, bumper hooks, or similar
impeding
devices shall be provided where there is a hazard of overtravel or
overturning.
30 CFR 56.9304: Unstable Ground - Dumping locations shall be visually
inspected prior
to work commencing and as ground conditions warrant.
