Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to fall hazards:
(a) Employees were exposed to fall hazards while riding the manlift not
equipped with
adequate fall protection, in the East House at South Central Grain in
Napoleon, ND.
(b) Employees were exposed to fall hazards while riding the manlift not
equipped with
adequate fall protection, in the North House at South Central Grain in
Napoleon, ND.
Among other methods, acceptable and feasible means of abatement would be
for the
employer to install a guarding system on the manlifts or purchase and
install manlifts that
are already equipped with a guarding system.

working on the top
of railcars during loading operations at South Central Grain Elevator in
Napoleon, ND.
(b) At the East House, employees were exposed to fall hazards while
working on the top
of railcars during loading operations at South Central Grain Elevator in
Napoleon, ND.
Among other methods, one feasible and acceptable means of abatement would
be for the
employer to install a fall protection system similar to the one installed
at the North House
of this facility.

(a) Employees were exposed to impact hazards while pulling railcars with a
tractor using
a single rope at South Central Grain in Napoleon, ND.
Among other methods, feasible and acceptable methods of abatement would be
for the
employer to change the method of moving railcars by pushing them instead
of pulling
them or by using a secondary rope/chain connected from the front of the
tractor
to the
railcar to totally secure the tractor.
