Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Employees were exposed to fall hazards while working from job constructed personnel platforms which were not evaluated to ensure safe platform design requirements were met. Among other methods, one feasible and acceptable means of abatement would be to provide a personnel platform which complies with the design requirements stated in the American Society of Mechanical Engineers document, ASME B56.6-1992, Safety Standard for Rough Terrain Forklift Trucks, sections 5.15, "Elevating Personnel" and section 8, "Design and Construction Standards." Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Sample Abatement Certification Letter").
