Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a crushing hazard while progressing railcars:
(a)  On May 10, 2002, while pulling railcars with a nylon tow rope hooked
to the back
end of a loader, a hazardous condition developed when the moving railcars
overtook the
loader and the operator exited the loader and attempted to set the railcar
hand brake.
Among other methods, one feasible and acceptable abatement method to
correct this
hazard is to push rather than pull the railcars and to insure that all
affected employees
are trained in the recognition of the hazards associated with the
progression of railcars.
