Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by falling suspended loads: (a) In shop area, Patrick AR 8 forklift was being operated under suspended hopper when retrieving a larger hopper from an area further inside shop. One feasible and useful method to correct this hazard would be to cease operating under suspended loads, remove hopper to other location and then retrieve larger hopper bin. Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement Certification Letter").tion
