Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to an unstable ATV due to exceeding the manufacturer's rear
cargo rack weight
specification:
(a) An employee was operating an ATV that had a sprayer on the rear cargo
rack that
exceeded the manufacturer's maximum weight specification.  Among other
methods, one
feasible and acceptable method to correct this hazard would be to use a
smaller sprayer
that meets the weight specifications stated in Honda's 1997 TRX400FW
Fourtrax
Foreman 400 owner's manual.
