North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees conditions of employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees:
a)outside building, on January 24, 2001, an
employee fell from a metal platform raised by
a rough terrain forklift approximately 7'1"
above ground level.  The platform contained an
open side and end with an incomplete guardrail
system, was not secured to the forks, extended
1'5.5" from both sides of the overall width of
the truck, and was not designed to be utilized
with a rough terrain forklift.
NOTE:Among other methods, one feasible and
acceptable method to abate this hazard is to:
1. Construct a stationary work platform from
ground level that does not require the
use of a forklift.
2.  Construct a platform in accordance with
ANSI B56.6 and ANSI B56.1.
3.  Equip employees with fall protection
systems as outlined in 29 CFR 1926
Subpart M Fall Protection.
4.  Consult and adhere to the forklift
manufacture's recommendations on the
types of platforms suitable to be
utilized.
