North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)jobsite Lot#13431, an employee was observed standing on the bed of an elevated mortar pan which was attached to a New Holland LS 180 Skid Steer. The employee was approximately 10 feet above the ground. The employer did not take measures to protect employee from a fall hazard. NOTE:Among other methods, one feasible and acceptable method to abate this hazard is to provide and utilize a personal cage which is designed to be utilized on a forklift.
