Section 5(a)(1) of the Occupational Safety & Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that: On May 8,2001, employees working in cofferdam 2E were exposed to crushing injuries and/or drowning resulting from structural failure of the cofferdam.The inability of cofferdam 2E to withstand the forces acting on it resulted from deviations from the cofferdam's construction specifications and the construction procedures prescribed by its designer including the following: 1.Use of steel beams as wales which had been cut in half (lengthwise), or cut to remove portions of the outer flange, so that the sheets piling bore directly on the beam webs. 2.Removal of the water from the interior of the cofferdam before all structural members had been installed. 3.Substitution of 1 1/8 inch diameter wire rope where the cofferdam plans called for W14x86 steel beams to support and brace the wales at the second and third tiers. 4.Failure to install the specified notch wale shims before de-watering the cofferdam, instead welding the deformed pile sheeting directly to the second tier wales. 5.Substitution of the following structural members with those that were smaller and weaker than those specified: all four wales at the third tier and one wale at the second tier, all four corner braces at the third tier and two corner braces at the second tier,the middle strut of the second tier. 6.Failure to install the stiffeners specified for wale to wale, wale to strut and wale to corner brace conditions. 7.Use of steel members with unknown strength ratings, some with welded splices, where the design specifications called for 50 ksi steel. One feasible and acceptable abatement method would be for the employer to insure cofferdams are constructed in accordance with their design, and to use only designs created, modified, only by those qualified to design cofferdams.
