Section 5(a)(1) of the Occupational Safety & Health Act of 1970:  The
employer did not furnish
employment and a place of employment which were free from recognized
hazards
that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to the hazard of being run over by the wheels of a backhoe in the
event that the
employee riding on the side step of the backhoe fell while the backhoe was
in motion.  Among
other methods, one feasible and acceptable abatement method to correct
this hazard would be
for the employer to provide a motor vehicle, designed and approved for
transporting passangers
from one location to another location.
Location:  Job site.
An employee was riding on the side step of a backhoe as it was traveling
down
the road.ling
