Section 5(a)(1) of the Occupational Safety & Health Act of 1970:  The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees, in
that, employees were
exposed to being struck by the swinging counterweight of an excavator:
Job Site: Excavation.
Employees were walking in close proximity to and exposed to being struck
by the
rotating counterweight of a Caterpiller 330 excavator where there was no
swing radius
protection system utilized.
One method of abatement, among others, would be to install high visibility
warning
markings on the three sides of the counterweight and to instruct the
employees to stay
out of the danger zone.
