Section 5(a)(1) of the Occupational Safety & Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to serious injury when concrete truck traveled onto the construction site and drove into a soft shoulder while making a turn. Location: Convention Center, 420 D Street S Boston, MA The employee, while driving a concrete truck through the construction site and drove into a soft shoulder causing the truck to tip over. Among other methods one acceptable method would be to ensure vehicle are used on access roadways which can accommodate safely the movement of equipment and vehicles.
