A.R.S. 23-403.A.: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to his/her employees from exposure to methylene diisocyanate (MDI) without pre-placement and annual medical examinations to rule out the employee's sensitization to MDI. The National Institute for Occupational Safety and Health (NIOSH), as well as chemical producers of MDI, recommend (through MSDS information provided with the chemical's purchase) to employers that medical surveillance, including pre- placement and annual medical exams, be conducted to prevent exposing sensitized employees to MDI. a) Roof Manufacturing: The employer failed to provide medical surveillance for employees who were being exposed to methylene diisocyanate (MDI) on a 40 hrs/wk frequency. This chemical is being applied by employees as a liquid stream, which then turns into a foam seal under the roof structure of the mobile homes. At least 2 employees were identified as users of MDI (Foamseal).
