North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees conditions of employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees:
a)in heat exchange area;  a 47" high mobile ladder stand
with bent/damaged support bracing, top step, bent/altered
legs was used by employees and not removed from service.
b)in heat exchange area;  a 35" high mobile ladder stand
with bent support brace, damaged top platform, and
damaged/bent casters/legs, was used by employees and not
removed from service.
c)in heat exchange area; a 19" high mobile ladder stand
with bent, cut/altered legs, was used by employees and
not removed from service.
d)in heat exchange area; inadequate training and use of
ladder stands and step ladders used by employees.
Among other methods to correct these hazards are to not modify
or alter manufactured ladder stands, inspect, maintain, and
repair ladder stands, to eliminate all damaged parts, and
assure proper use of ladder stands and step ladders by
employees, through observation and training.
