North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)the ASME propane container - the employer did not requalify the propane container for continued service following involvement with a fire. Ref:1992 Edition, NFPA, Volume 3, Sections, 2-2.1.2 & 2-2.1.4 NOTE:Among other methods, the feasible and acceptable method to abate the hazard is to replace the LP Gas container with a new cylinder. b) the Ford F350 XL truck exhaust system (22 trucks) - the employer did not assure that the exhaust system of the catering trucks had cooled before the transfer [of LP Gas] is started. Ref:1992 Edition, NFPA, Volume 3, Sections, 3-7.4 & 4- 2.3. NOTE: Among other methods, the feasible and acceptable method to abate the hazard is to assure the exhaust system of the vehicles mounted with LP Gas containers have been allowed to cool before the transfer of LP Gas is initiated.
