Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls from heights: a. South side of the building, outside--the JLG 120HX, aerial lift's basket had severly bent guard rails and vertical posts and the platform (basket) was twisted and bent enough that the latch for the door (gate) would not properly engage. One method of abatement is to inspect the aerial lift prior to each use and remove the aerial lift from service when the work platform is damaged and/or the latch for the door (gate) will not lock properly.
