Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Falls from forklifts, in that; the operator of the Toyota forklift was not using the seat belt that was installed on the forklift and the unauthorized rider did not have a seat belt available for his use. One acceptable means of abatement is to require the operator of the forklift to use the installed seat belt anytime that the lift is being used.
