North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a falling hazard: a)plant, abrasive blasting booth - employees performing blasting operations must access the top of frac tanks (10'10" high at the low end) in order to blast the top of the tank. Employees use an eight foot metal step ladder that does not reach the top of the frac nor extend the recommended 3 feet beyond the working platform, additionally, the employees have to use the top of the ladder as a step. REF: 1910.25(d)(2)(xii) and 1910.25(d)(2)(xv). b)plant, B-40 paint booth - employees performing painting operations must access the top of frac tanks (approximately 10'11" high at the low end) in order to paint the top of the tank. Employees use an 11'9" metal fold-out ladder that extends approximately 4-6" past the working platform, it does not extend the recommended 3 feet beyond the working platform. Additionally, the employees have to use the top of the ladder as a step. REF: 1910.25(d)(2)(xii) and 1910.25(d)(2)(xv). c)plant, welding area, bay 1 - employees performing welding operations must access the top of frac tanks (8'8" high at the low end) in order to weld the top of the tank. Employees use an eight foot fiberglass step ladder that does not reach the top of the frac nor extend the recommended 3 feet beyond the working platform, additionally, the employees have to use the top of the ladder as a step. REF: 1910.25(d)(2)(xii) and 1910.25(d)(2)(xv). ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD, AMONG OTHERS, TO CORRECT THIS HAZARD IS TO PROVIDE THE EMPLOYEES WITH LADDERS THAT WILL EXTEND THREE FEET PAST THE WORKING PLATFORM (TOP OF THE FRAC).
