North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)job site, - fall from high elevation - a trial lift with anticipated load was not performed prior to lifting employees on material hoist load line. Reference: NCDOL, CPL 2-1.29 Interim Inspection Procedures During Communication Tower Construction Activities, Appendix A, Section 3, paragraphs a through h and the National Association of Tower Erectors, Second Edition-as amended, September 1997, Accessing Radio, Television, Communications Towers and Similar Structures.(Procedures for free climbing, procedures for riding the line and hoist parameters, page 9, section 23, paragraph 1.) b)jobsite, - fall from high elevation - a pre-lift meeting was not conducted prior to each trail lift.
