North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing hazard. a)job site - employees were allowed to work inside and in close proximity of a facility with numerous structural defects, i.e. cracks and unstable masonry walls, loose roofing membrane, significant settlement cracking, undersized foundations, inadequate/damaged roof subpurlin attachment, and a masonry chimney which is cracked and rotated. One feasible and acceptable abate method, among others, to correct this hazard is to repair the defective areas of the facility to ensure it can withstand the applicable structural requirements of the building codes, or permanently remove employees from the job site.
