North Carolina General Statutes 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death of serious physical harm to employees, in that employees were exposed to a fall hazard: Operators of refuse collection vehicles do not ensure that no persons ride on riding steps when the vehicle is exceeding 10 mi/hr [ref. ANSI Z245.1-1992 Sec.6.2.4(a)]: a)collection routes - employees riding on rear riding steps of moving refuse collection vehicle in excess of 10 miles per hour. One feasible and acceptable abatement method, among others, to correct this hazard is to train drivers not to exceed 10 mph while employees are riding on rear riding step, and ensure that caution signs, are posted above riding step, explaining the above standard.
