North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: a)facility - where employees were allowed to stand in close proximity of and reach underneath hoisted loads (i.e., parts, equipment) of an overhead hoist, including but not limited to Coffing 1 ton chain hoist, and appurtenance(s) that were not load rated. Abatement note: One feasible and acceptable method, among others, is to load rate the appurtenances to ensure that they withstand the rated load capacity.
