North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish
each of his employees conditions of employment and a place of
employment free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to carbon monoxide:
a)large refrigerated storage cooler - on 07/26/2001,
employees used a Yale brand, Model No. GTP030AFNVAE084,
propane powered forklift for picking vegetable orders.
Employees were exposed to airborne carbon monoxide
concentrations of 378 parts per million as calculated
from an employee's medical record which documented a
blood carboxy-hemoglobin level of 40.3 The permissible
exposure limit (not to be exceeded, based on an 8-hour
time weighted average) for carbon monoxide is 35 ppm 8-
hour time weighted average.  The ceiling limit (not to be
exceeded at any time during the day) for carbon monoxide
is 200 ppm.
Among other methods, one feasible and acceptable
abatement to correct this hazard is to replace the liquid
propane-gas forklift with an electric forklift.
