Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by or crushed by falling pallets of product due to a failure of the rack system: (a)Date of Violation:06/26/01 Location:Aisle 5A-02 Condition:Pallets of product, weighing from approximately 2000 pounds, were stored on storage racks from which locking pins prevent displacement of crossmembers were missing. Among others, one feasible and acceptable abatement method to correct this hazard is to replace all locking pins missing from the storage rack system, and develop and implement a maintenance program that provides for inspection, maintenance and repair of the storage rack systems. Abatement documentation (photographs, receipts, copies of programs, training certification, etc.) is required for this item.
