Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Production area - the foot switches for the Famco 36-inch shear (OSHA formerly referred to this as a Wysong 36-inch shear) and the Wysong 72-inch shear were not protected to prevent their actuation from falling or moving objects, or from their unintended actuation by accidentally stepping onto the foot control. Among others, one method of abatement is to equip the shears with foot switches that meet the design requirements as prescribed in the American National Standard for Shears, ANSI B11.4-1993, or later edition. Abatement certification only is required for this item in accordance with 29 CFR 1903.19(c).
