Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to serious crushing hazards from tipping roll-off boxes:
On or about March 21, 2002, an employee loaded a 23 ft roll-off box on the
Clement triple axle,
two box, roll-off trailer, while exposed to the crushing hazard of a box
tipping and falling on
the operator during the loading procedure.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT
METHOD TO CORRECT THIS HAZARD IS:
Providing information and training to employees on the proper operation of
the Clement triple
axle two box roll-off trailer, including: 1) using the literature as
provided by the manufacturer(s)
to assist training, and 2) requiring practical hands on training in
equipment operation and
maneuvering of the tractor/trailer in forward/reverse and
loading/unloading scenarios including
full and empty container moving/hauling, 3) requiring the operator to walk
around the trailer and
inspect the box to insure it is properly aligned before completely
winching it off the ground and
again before transferring it to the second stage of the two-box trailer,
and 4) require the two box
roll-off equipment be operated by a two person team to ensure it is
properly aligned during the
loading process.
Abatement certification is required for this violation (using the
CERTIFICATION OF
CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating
that
abatement is complete must be included with your certification.  This
documentation may include,
but is not limited to, evidence of the purchase or repair of the
equipment, photographic or video
evidence of abatement, or other written records.
