Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a)Employees used the fiberglass stepladders as straight ladders when accessing the air handling units and changing light bulbs on the decks, thus exposing the employees to a fall hazard. (b)Employees stood on the top caps and the top steps of the fiberglass stepladders while accessing the air handling units, thus exposing the employees to a fall hazard. While ultimate responsibility for correcting the hazards rests with the employer, given its knowledge of the workplace, feasible and acceptable methods to correct the hazards, among others, are: (1) provide straight ladders for employee use during maintenance work; (2) provide ladder safety training to employees. Abatement Note: Abatement certification for this violation is not required.
