Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to hazard of falls: (a)St. Martin Switch Frame Assembly, 115kV, 3-Way GOAB - On April 3, 2001, on the switch tower assembly, employees exposed to the hazard of falling while entering and exiting a personnel basket attached to the boom of a truck crane. The basket was not secured to the structure and employees were not tied off while entering and exiting the basket. Among other methods, one feasbile and acceptable method to abate this hazard would be to follow the National Crane owner's manual for the Two-Person Rotating Steel Basket, which states under 'Platform Occupants', #14. "Personnel Platform Occupants shall not enter or exit a suspended platform while it is raised unless the platform has an installed gate and the platform is physically secured to the structure to which they are entering or exiting and to which they have attached their safety harness lanyard."
