Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: Hazard of Fall. (a)George County All-Purpose Building - Quality Sheetmetal employees were observed to be utilizing the Angus Palm Skytrak Rough Terrain Forklift (Serial #59, Model #B8400) owned by KEL Construction to gain access to/from the 17' roof level area of the building by standing on and riding the forks of the lift. Among other methods, one feasible and acceptable method to correct hazard is to prohibit employees from standing and riding on forks of the forklift.
