Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: hazard of being struck-by and falling from moving equipment. (a) Super Walmart Construction Site - An employee was exposed to struck-by and fall hazards while standing on the side-step of a JLG/Gradall G6-42A Material Handler riding riding around the rough terrain jobsite on April 18, 2002. (b) Super Walmart Construction Site - An employee was exposed to struck-by and fall hazards while sitting in the rear-wheel hub of an unidentified front-end loader while traveling on rough terrain on April 16, 2002. Among other methods, one feasible and acceptable method to correct this hazard is to: Prohibit all riders from riding on material handler(s) and front-end loader(s).
