Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: death by crushing while operating a tractor without wearing seat-belts. (a)Grinding Plant, at North end - The employee operating the John Deere tractor, #11, equipped with both a Roll-Over Protective Structure and a box-blade, to smooth dirt inside and outside the Grinding Plant, was not wearing a seat-belt. Among other methods, one feasible and acceptable abatement method to correct this hazard is to require the mandatory wearing of seat-belts during the tractor's operation.
