Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a fall hazard of 15 feet when working on top of rail cars: a. In the receiving area, receiving and quality assurance employees removed samples of product from the top of rail car hoppers without fall protection. Among other methods, one feasible and acceptable method to correct this hazard would be to install a static line from the roof supports and provide lanyard and harness for employees working on top of the rail car. Abatement verification is required for this violation. The abatement certification sheet is enclosed with the citation(s).n
