Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (being struck by material during the infrequent operation of an overhead hoist: a.In the molding department ("Herman 2"), where a 1 ton overhead hoist was used to raise and lower a fabricated steel plate door for entry into a storage room, the safety latch was missing from the hoist hook; the door became dislodged from the hook striking an employee and causing severe injury.
