Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) At the time of the inspection, the truck drivers were exposed to a (8") eight foot fall hazard to ground level from a platform located on the rear side of the cement mixer trucks. The entrance opening to the work platform was not equipped with a guardrail system. Among other feasible and acceptable methods to correct this hazard would be to : install a chain or other mechanically strong material across the entrance opening to the work platform. This chain or other mechanically strong material would be left in the open position while employees access the work platform. Once the employees gained access to the work platform, the chain or other mechanically strong material would be secured in the closed position. Another feasible method for guarding this open side would to install a swinging gate which could be secured in the open position while employees accesses the work platform. Once employees gain access to the work platform, the swinging gate could be secured in the closed position.
