Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of contact with a rotating saw blade: (a) Weld Shop - the vertical cut off metal band saw was not equipped with a control starter that was so located, designed, constructed, interlocked, or guarded to protect against unintended operation; and secondly, the saw was not equipped with a device that, in the event of an interruption in the electrical power supply, the machine cannot restart automatically when power is restored. Among other methods, one feasible and acceptable method to correct this hazard is to follow those standards as prescribed in ANSI B11.10-1990. American National Standard for Metal Sawing Machines.
