caidas segun se describe en el renglon # 3.  El pasado 31 de agosto de
2001 en
este establecimiento un empleado estuvo trabajando en las mismas
condiciones
explicadas anteriormente y murio cuando se cayo desde 18'5" de altura sobre
el piso.  Basandonos en el informe de autopsia realizado por el Instituto
de
Ciencias Forenses donde estos explicaron las condiciones criticas en que se
encontraba el empleado y enfatizando una vez mas los renglones 3, 4 y 5 de
Section 6(a) of the Puerto Rico Occupational Safety and Health Act:  The
las deficiencias del mecanismo encontradas por los CSHOS ademas de
considerar la altura de 18'5" sobre el piso no hay otra explicacion logica
para
esta fatalidad que establecer que dicho empleado se cayo por la falta de
proteccion contra caidas en el area del apeadero superior.  Nuestra teoria
establece que el empleado se cayo desde el area del apeadero a traves del
espacio libre del recorrido del mecanismo cuando dicho equipo estaba

Este mecanismo fue revisado muchas veces tanto por un servidor como por el
Sr. Marvin Delgado Ingeniero calificado y con una vasta experiencia en
calderas, ascensores y equipos relacionados el cual pertenece a la
Division deAscensores y Calderas de OSHO, para verificar su funcionamiento
para
verificar su funcionamiento.  Los CSHOS le realizaron muchas pruebas para
tratar de sacar el gancho mientras el mecanismo estaba en movimiento pero
este continuaba funcionando muy bien.  En esta prueba el movimiento lateral
estaba limitado por los rieles.  Estos realizaron pruebas de frenos y los
causando o que
mismos
estaban funcionando correctamente.  Tambien cambiaron dos veces la posicion
del gancho para observar el mecanismo y este continuo trabajando muy bien.
Ademas la caja de metal instalada en la parte superior del equipo la cual
recogia la cadena del malacate (pateca), cuando el carro estaba corriendo
hacia
arriba, fijaba el gancho instantaneamente evitando que el gancho se
saliera de
sitio, en otras palabras un desenganche nunca ocurrio cuando los CSHOS
hicieron las pruebas una gran cantidad de veces.  Otro punto es el hecho de
puedan causar muerte o dano fisico a los empleados, por cuanto empleados
que el mecanismo no se cayo mientras el empleado estaba ajustando el equipo
porque hubiera necesitado una gran escalera portatil para tratar de
alcanzar la
caja de metal y el malacate electrico de cadenas (pateca).

Entre otros metodos, un metodo de correccion factible y aceptable para
corregir este riesgo es la definicion de dicho mecanismo por el patrono
identificando si el equipo es un transportador vertical reciproco el cual
necesita
cumplir segun especificado en el ANSI/ASME B20.1. supervisado obviamente
por un ingeniero licenciado calificado o la instalacion de un elevador o
equipo
relacionado.  La inscripcion e inspeccion de estos equipos debe cumplir
con lo
establecido en la Regla Especial # 5 bajo la jurisdiccion de la Division de
Ascensores y Calderas de OSHO.  Este equipo debe ser disenado de acuerdo
al Codigo ANSI/ASME A17.  Los equipos recomendados bajo la nominacion
de tipos de elevadores son:
1.Elevador de carga
2.Elevadores de materiales o montabultos con dispositivos de
transferencia automatico."a
exclusive transportation of guided loads from a level to another which was
called by the employer as "freight elevator".  There are not any evidence
about the design, installation, permissible maximum capacity and weight
limits, operation, inspection and maintenance of this mechanism according
to
any existing standard for equipment with similar functions such as vertical
reciprocating conveyors or elevators and/or related equipment (ANSI B20.1
or
ANSI A17.1).  This mechanism did not have safety devices as barriers or any
type of guard to avoid falling hazards from the charge and discharge land
areas with an interlace which could be open only when the carrier stops on
the
level and in such a manner that cannot be move until these devices are
close
completely (Article 6.21.2 (B) - ANSI B20.1).  When the CSHOS
(Compliance Safety & Health Officers) arrives to the workplace the
mechanism called by the employer "freight elevator" had another
deficiencies:
1.The equipment works with a electrical chain hoist and the safety latch
doesn't works.  Its was fixed to a iron crosspiece. (Section 10-1.2.3 (d)
- ANSI/ASME B30.10 "hooks".
2.The using of the top limit device as normal way of stop.
(Section 16.3.1.3 (m) - ASME B30.16 "Overhead Hoist").
3.Tripping and falling hazards located at the land station of the top level
because there were a lack of guardrails, gates, automatic enclose areas
or doors on land areas that avoid the access to the space of the car
travel.
4.There were a protuding piece of steel placed on the floor and a loose
piece of lumber of 2 x 4 both near to the edge of the floor used as a
land area.
5.The car was made of iron frame without walls, guardrails or doors.
This mechanism was open completely all around, at the top area and
had two iron diagonal crosspieces.  In addition this mechanism was
designed to be occupied by persons, because any employee can enter on
it due to the commodity of its dimensions.  It was made for the normal
size of a person.
6.The operation switch was fixed in the wall of the first level.  It is
consist of two buttons of continue pressure which make that the
mechanism works upward and downward.
Location:  Warehouse area
Employees were using this mechanism continually to carry the merchandise
from a level to another with a distance path of 18'5" high above the floor
without any fall protection system as described on item # 3.  Last august

2001 at this establishment an employee was working in the same conditions
explained before and died when he fell down from 18'5" high above the
floor.
Based on the autopsy report performed by the Forensic Science Institute
where
they explained the critical conditions that employee was met and
emphasizing
one more time items 3, 4, and 5 of the mechanism deficiencies found it by
the
CSHOS in addition of the high of 18'5" above the floor, there are not other
logical explanation for this fatality that establish such employee fell
down due
to the lack of fall protection at the top land area.  Our theory establish
the
employee fell down from the land area through the free space of the
mechanism travel when such equipment was located at the bottom area.
Probably the employee trip with the protuding metal piece located on the
floor
and the loose piece of lumber of 2 x 4 near to the edge of the open sided
floor
at 18'5" high above the floor causing the falling automatically.
This mechanism was checked too many times by me and Marvin Delgado a
qualified Engineer with a great experience on boilers, elevators and
related
equipment which belong to OSHO Boilers and Elevators Division, to verify
its
working.  The CSHOS made a lot of tests to try of take out the hook while
the
mechanism was in movement but it continues working very good.  In this test
the lateral movement was limited by the rails.  They performed brake tests
and
they were working correctly.  Also they changed two times the position of
the
hook to observe the mechanism and such equipment continued working very
good.  Furthermore the metal box installed at the top of the equipment
which
gathered the hoist chain when the car was running upward fixed the hook
instantly avoiding the hook took out of place, in another words an unhook
never happened when the CSHOS made the tests several times.  Another point
is the fact the mechanism did not fall down while the employee was
adjusting
the equipment because he should need a big portable ladder to try to reach
the
metal box and the electrical chain hoist.Among other methods, one feasible
and acceptable abatement method to
correct this hazard is the definition of such mechanism by the employer and
identifying if the equipment is a vertical reciprocating conveyor which
need to
comply as specified on ANSI/ASME B20.1. supervised obviously by a
licensed qualified engineer or the installation of a elevator or related
equipment.  The inscription and inspection of these equipments must be
comply as established on Special Rule # 5 under the jurisdiction of OSHO,
Division of Boilers and Elevators.  This equipment must be designed
according
to the Code ANSI/ASME A17.  The recommended equipment under the
nomination of types of elevators are:
1.Freight elevator
2.Materials lifts and dumbwaiters with automatic transfer devices.
Riesgos de caidas a 18'5", ocasionando contusiones severas, multiples
fracturas, abrasiones, laceraciones, hemorragias y muerte.
a)En el lugar de trabajo conocido como San Expedito Liquor Store -
Empleados
estuvieron trabajando diaria y continuamente como despachadores de
mercancia utilizando un mecanismo de 5'5" de alto y una plataforma de 6' x
4' con 8 ruedas y 4 rieles utilizado para la transportacion de cargas
guiadas de
un nivel a otro el cual fue llamado por el patrono como "elevador de
carga".
No hay alguna evidencia acerca del diseno, instalacion, limites de
capacidad y
peso maximos permitidos, operacion, inspeccion y mantenimiento de este
mecanismo de acuerdo a cualquier estandar existente para equipo con
funciones similares tales como transportadores verticales reciprocos o
ascensores y/o equipo relacionado (ANSI B20.1 o ANSI A17.1).  Este
mecanismo no tenia dispositivos o barreras o cualquier tipo de resguardo
para
evitar riesgos de caidas desde el apeadero de carga y descarga con un
entrelace
el cual pueda ser abierto solamente cuando el cargador se detenga en el
nivel
de manera que no pueda ser movido hasta que estos dispositivos sean
cerrados
completamente (Articulo 6.21.2 (B) - ANSI B20.1).  Cuando los CSHOS
(Compliance Safety & Health Officers) llegaron al lugar de trabajo, el
mecanismo llamado por el patrono "elevador de carga" tenia otras
deficiencias:
1.El equipo trabaja con un malacate electrico de cadenas (pateca) y el
seguro de gancho no funcionaba.  Fue fijado a una cruceta de acero.
(Seccion 10-1.2.3 (d) - ANSI/ASME B30.10 "hooks".
2.La utilizacion del dispositivo de limite superior como medio normal de
parada.  (Seccion 16.3.1.3 (m) - ASME B30.16 " Overhead Hoist").
3.Riesgos de tropiezos y caidas localizados en el apeadero del nivel
superior porque habia una falta de barandas, portones, areas
encerradasautomaticas o puertas en los apeaderos que eviten el acceso
hacia el
espacio del recorrido del carro.
4.Habia una pieza de hierro protuberante colocada en el piso al igual que
una pieza de madera de 2 x 4 cerca del borde del piso utilizada como
apeadero.
5.El carro fue hecho de armazon de hierro sin paredes, barandas o
puertas.  Este mecanismo era abierto completamente en todos los
alrededores, en la parte superior y tenia dos crucetas de acero
diagonales.  Ademas este mecanismo fue disenado para ser ocupados
por personas, porque cualquier empleado puede entrar en el debido a la
comodidad de sus dimensiones.  Fue hecho para el tamano normal de
una persona.
6.El interruptor de operacion fue fijado en la pared del primer nivel.
Este consiste de dos botones de presion continua el cual hace que el
mecanismo funcione hacia arriba y hacia abajo.

Empleados estuvieron utilizando este mecanismo continuamente para
transportar la mercancia de un nivel a otro con un una distancia de
recorrido
de 18'5" de altura sobre el piso sin tener algun sistema de proteccion
contra
