Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: Punctures hazards at the point of operation causing contusions, crushing, lacerations, abrasions, fractures and useless. a)At the workplace known as Edwards Life Science Corp - Employees were working at the compression molding area using a machine to make inserts called Transfer Press #1, Model EQ233 230 V, Serial number 4261 which had a two buttons system that require to be press at the same time by the employee with both hands and then the machine works. This system failed so many times in such a manner when the machine finished the complete cycle the platform below was supposed to not work until the operator begins the cycle and press the two buttons again. This platform was rising up althought the employees were take out the moulds of the point of operation without opress the two buttons. This situation occurred at the followings dates: 11/20/01, 11/27/01, 12/08/01, 12/11/01 and 3/19/02. Also a limit switch was installed to try to switch off the machine when the cycle was completed, but this system did not work and the machine was doing the same thing without the two buttons were pressed. The corrective measures taked by the employer were not completely effective and the employees were exposed to the conditions described before due to the lack of identification existing and predictable hazards or working conditions which are unsanitary, hazardous or dangerous to them at the mentioned work area. On march 19, 2002 an employee had a lamentable accident where the left hand was punctured with 300 pounds of pressure or more by the previous mentioned machine and suffered several harms such as crushing, lacerations and the lack of movement of this hand almost useless due to the multiples fractures. Location:Compression Molding Area Among other methods, one feasible and acceptable abatement method to correct this hazard is the installation of a machine guarding system that enclosed completely the whole area of the point of operation in such a manner when the machine is working on the normal cycle nobody can open the guarded area to try to touch this point of operation unless the machine finish the cycle. If any employee want to open the enclosed area before the cycle is completed while the machine runs a lock system must be implemented to avoidthe access to the platform. If the employee open this area anyway then the machine must be switch off automatically. Riesgos de pinchazos en el punto de operacion ocasionando contusiones, aplastamiento, laceraciones, abrasiones, fracturas e inutilidad. a)En el lugar de trabajo conocido como Edwards Life Science Corp - Empleados estuvieron trabajando en el area de "Compression Molding" utilizando una maquina para hacer "inserts" llamada Transfer Press #1, modelo EQ233 230 V, numero de serie 4261, la cual tiene un sistema de dos botones que requieren ser oprimidos a la misma vez por el empleado utilizando ambas manos y entonces la maquina funciona. Este sistema fallo varias veces de manera tal que cuando la maquina terminaba el ciclo completo, la plataforma de abajo estaba supuesta a no funcionar hasta que el operador comenzara el ciclo y oprimiera los dos botones nuevamente. Esta plataforma subia aunque los empleados estuvieran sacando los moldes del punto de operacion sin oprimir los dos botones. Esta situacion sucedio en las siguientes fechas: 11/20/01, 11/27/02, 12/08/02, 12/11/02 y 3/19/02. Tambien un interruptor limitador fue instalado para tratar de apagar la maquina cuando fuera completado, pero este sistema no funciono y la maquina seguia haciendo lo mismo sin los dos botones ser oprimidos. Las medidas correctivas tomadas por el patrono no fueron completamente efectivas y los empleados estuvieron expuestos continuamente a las condiciones descritas anteriormente debido a la falta de identificacion de riesgos predecibles y existentes o condiciones de trabajo las cuales no son sanitarias, arriesgadas, peligrosas para ellos en la mencionada area de trabajo. En marzo 19 de 2002 una empleada tuvo un lamentable accidente donde la mano izquierda fue pinchada con 300 libras de presion o mas con la maquina antes mencionada previamente y sufrio danos severos tales como aplastamiento, laceraciones, y la falta de movimiento de esta mano casi inutil debido a las multiples fracturas. Localizacion: Area de "Compression Molding" Entre otros metodos, un metodo de correccion factible y aceptable para corregir este riesgo es la instalacion de un sistema de resguardo de maquina que encierre completamente el area del punto de operacion de manera tal que cuando la maquina este trabajando en el ciclo normal, nadie pueda abrir el area resguardada para tratar de tocar el punto de operacion a menos que la maquina termine el ciclo. Si cualquier empleado quiere abrir el area cerrada antes de que el ciclo sea completado mientras la maquina corre entonces un sistema de seguro debe ser implementado para evitar el acceso hacia la plataforma. Si el empleado abre de todas maneras esta area, entonces la maquina debe apagarse automaticamente."ion

Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: Fractures, contusions and lacerations a)At the workplace known as Edwards Life Sciences Corp - An employees was working in the process of cleanness the mould of one of the molding machine which weight more than 200 pounds. A piece of lumber 2 x 4 was placed under the mould to wedge it and make balance. During the process of cleanness the employee tried to take out one of the parts of the mould with his hands and one of his fingers was inside of the piece when the wooden wedge did not resist the weight and the mould fell down over an angular piece. Althought the employee tried to take out his finger on time he could not do it and suffered a fracture of his thumb finger instantly. The employer did not instructed each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazard or other exposure to illness or injury. The trainings provided to the employees were not sufficiently wide to cover all of the safety procedures required to perform the moulds cleanness process. Also this employee was working on a third shift alone and without any supervision of the staff personal. Location: Machine Shop area Among other methods, one feasible and acceptable abatement method to correct this hazard is provide to the employees working in the process of cleanness this type of mould a complete safety training with specific safety measures including the recognition and avoidance of unsafe conditions in such a manner that any hazard could be eliminate at any moment. This training must require the fabrication of one wedge for each mould which have the same material of the mould. Also these wedges could be installed easily to create more stability and balance at the moment of the cleaning process and the easiness of take off such wedges when the operation is completed. Once the mould is carried out to the Machine Shop area for the process of cleanness and at the moment of the installation of the wedge, it must be lifted with a grade # 8 chain or any other good quality chain by an underhung crane located in the area, during the cleanness and when the process will be finished. Not withstanding the wedges will be fixed with bolts if some of them fail anyway at any moment, then there not exist the hazard that the mould could fall overthe table because such piece is being sustain by the underhung crane all the time. Another important condition is the fact of include at least two or more employees on the third shift to work in this area, on another words any employee must not work alone. In addition a continue supervision of the staff personal is recomended to verify the quality of the job, if they are doing the job correctly, safe and free from recognized hazards. In case of an emergency there are a greater amount of persons that can help to manage the situation diligently and a more effective manner. Fracturas, contusiones y laceraciones. a)En el lugar de trabajo conocido como Edwards Life Sciences Corp. - Un empleado estuvo trabajando en el proceso de limpieza de un molde de una de las maquinas de "molding", la cual pesa mas de 200 libras. Se le coloco una pieza de madera 2 x 4 debajo del molde para calzarlo y hacer balance. Durante el proceso de limpieza el empleado trato de sacar una de las partes del molde con sus manos y uno de sus dedos estaba en el interior de la pieza cuando el calzo de madera no resistio el peso y el molde se cayo sobre una pieza angular. Aunque el empleado trato de sacar su dedo a tiempo, no pudo hacerlo y sufrio una fractura en el dedo pulgar en el acto. El patrono no instruyo a cada empleado en el reconocimiento y el evitar condiciones inseguras y las regulaciones aplicables a su ambiente de trabajo para controlar o eliminar cualquier riesgo u otra exposicion a enfermedad o lesion. Los adiestramientos ofrecidos a los empleados no fueron lo suficientemente abarcadores para cubrir todos los procedimientos de seguridad requeridos al realizar el proceso de limpieza de moldes. Tambien este empleado estuvo trabajando en un tercer turno solo y sin ninguna supervision del personal administrativo. Localizacion: Area de Machine Shop Entre otros metodos, un metodo de correccion factible y aceptable para corregir este riesgo es proveerle a los empleados trabajando en el proceso de limpieza de este tipo de molde un adiestramiento de seguridad completo con medidas especificas incluyendo el reconocimiento y el evitar condiciones inseguras de manera tal que cualquier riesgo pueda ser eliminado en cualquier momento. Este adiestramiento debe requerir la fabricacion de un calzo para cada molde el cual tenga el mismo material del molde. Tambien que estos calzos puedan ser instalados facilmente con tornillos para crear mas estabilidad y balance al momento del proceso de limpieza y la facilidad de sacar dichos calzos cuando la operacion es completada. Otra recomendacion es que desde que el molde llegue al area de Machine Shop para el proceso de limpieza y al momento de la instalacion de los calzos, debe ser levantado con una cadena de grado # 8 o de igual calidad por una grua suspendida que esta localizada en el area, durante la limpieza y cuando se haya terminado todo el proceso. A pesar de que los calzos estan fijos con tornillos, si en algun momento algunofalla, entonces no hay riesgo de que el molde se pueda caer sobre la mesa porque dicha pieza esta siendo sostenida por la grua suspendida todo el tiempo. Otra condicion importante es el hecho de incluir por lo menos dos o mas empleados en el tercer turno para trabajar en esta area, en otras palabras que ningun empleado debe trabajar solo. Ademas de que una supervision continua del personal administrativo es recomendable para verificar la calidad del trabajo, si ellos estan haciendo el trabajo correctamente, seguro y libre de riesgos reconocidos. En caso de una emergencia hay una mayor cantidad de personas que pueden ayudar a manejar la situacion diligentemente y de una manera mas efectiva."ente
