Section 6(a) of the Puerto Rico Occupational Safety and Health Act:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or physical harm to employees
in that employees
were exposed to:

El patrono no
proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten
causando o que
puedan causar muerte o dano fisico a los empleados, por cuanto empleados
estaban expuestos
a:
Retching, vomiting and dizziness hazards due to the fact of walking over an
inclinated floor, tripping and falling hazards with the irregular tiles
and floors
causing another injuries such as contusions, lacerations and abrasions,
burning
hazards in case of a fire because the employees cannot evacuate faster
because
the doors are adjusted completely due to the settlement.  Death hazards if
the
structure is submerged or fall down with employees working inside of it.
a)Employees were working daily and continually on a building which is
actually
in settlement.  Underneath of such structure there are too many water
sources
running continually which help to create a faster settlement.  Also this
structure have cracked the ceiling, floors, walls and stairways.  Some of
the
windows and doors cannot be open and close normally due to the unlevel.
The floor inclination measure was more of 3/4 inches of diference.  This
means from one extreme of the building to another there are 6" to 1' of
diference in the floor level and probably more, which prove that have a
great
unlevel.  Another problem is the amount of cracks located at the ceiling
which
continually causing water leakages when is raining and the plaster is fall
down
with regularity.  This situation was reported several times previously to
Mr.
Cesar Rey and Mr. Carlos Morales, Secretary and Regional Director
respectively of the Department of Education, Mr. Nevares, Julio Roman and
Edwin Barreto from OMEP, Ms. Zoe Cotte Operations Director of Mayaguez
Educative Region and MR. Melendez Osorio, Executive Director of the
Capacitation Profesional Institute and the situation never was resolved.
In
addition of the recent evaluation performed by the P.R. Fire Department
where the CSHO was in the walkaround, another one was performed for this
agency on september 14, 1999.  In both evaluations the P.R. Fire Department
recomended a certification of a structural engineer about the settlement
situation of this building.  They described the bad conditions of the
mentioned
building, the continue and faster settlement and the recomendation of avoid
that any employee could work inside of it meanwhile this hazards exits.
The
P.R. Fire Department personal said: "We did not indorse the use of this
facilities and The Department of Education is reponsible of any accident
that
could happens on this building actually, until they comply and correct
totally
the safety deficiencies required by the agency" It was a cite.
Location: West area of the Manuel Fernandez Juncos School, Mayaguez P.R..
Among other methods, one feasible and acceptable abatement method to
correct this hazard is remove all employees of this building until a
competent
structural engineer can perform a complete study of it and can demonstrate
if
whole structure is secure completely.  On the other hand if the study
establish
the opposite, then this building must be demolished and the employees must
be
relocated on another building.
Riesgos de nauseas, vomitos y mareos debido al hecho de caminar sobre un
piso inclinado, riesgos de tropiezos y caidas con las losetas y pisos
irregulares
ocasionando otras lesiones tales como contusiones,laceraciones y
abrasiones,
riesgos de quemaduras en caso de fuego porque los empleados no pueden
desalojar rapidamente porque las puertas estan completamente ajustadas
debido
al asentamiento.  Riesgos de muerte si la estructura se hunde o colapsa
con los
empleados  trabajando en su interior.
a)Empleados estuvieron trabajando diaria y continuamente en un edificio el
cual
esta actualmente en asentamiento.  Por debajo de dicha estructura hay
varios
manantiales de agua corriendo continuamente lo cual ayuda al asentamiento.
Tambien esta estructura tiene agrietado el techo, pisos, paredes y
escaleras.
Varias de las ventanas y puertas no pueden ser abiertas y cerradas
normalmente debido al desnivel.  La medida de inclinacion del piso fue de
mas
de 3/4 pulgadas de diferencia.  Esto significa que de un extremo del
edificio
hacia otro hay una diferencia de 6" a 1' en el nivel del piso y
probablemente
mas , lo cual prueba que tiene un gran desnivel.  Otro problema es la
cantidad
de grietas localizadas en el techo, lo cual causa continuamente
filtraciones de
agua cuando llueve y el empanetado se cae con regularidad.  Esta situacion
fue
reportada varias veces previamente al Sr. Cesar Rey y Carlos Morales
Secretario y Director Regional respectivamente del Departamento de
Educacion, El Sr. Nevarez, Julio Roman y Edwin Barreto de OMEP, la Sra.
Zoe Cotte, Directora de Operaciones de la Region Educativa de Mayaguez, y
el Sr. Melendez Osorio, Director Ejecutivo del Instituto de Capacitacion
Profesional y la situacion nunca fue resuelta.  Ademas de la reciente
evaluacion realizada por el Departamento de Bomberos de P.R., donde el
CSHO estuvo en el recorrido, otra evaluacion fue realizada por esta
agencia el
14 de septiembre de 1999.  En ambas evaluaciones el Departamento de
Bomberos de P.R. recomendo la certificacion de un ingeniero estructural
acerca de la situacion de asentamiento de este edificio.  Ellos
describieron las
malas condiciones del mencionado edificio, el continuo y rapido
asentamiento
y la recomendacion de evitar que cualquier empleado pueda en el interior de
este mientras los riesgos existan.  El personal del Departamento de
Bomberos
de P.R. dijeron: "Nosotros no endosaremos el uso de esta facilidades y el
Departamento de Educacion es responsable de cualquier accidente que
sucedaen este edificio actualmente, hasta que ellos cumplan y corrijan
totalmente las
deficiencias requeridas por la agencia".  Esto fue una cita.

Entre otros metodos un metodo factible y aceptable para corregir este
riesgo es
remover a todos los empleados de este edificio hasta que un ingeniero
estructural competente pueda realizar un estudio completo del mismo y pueda
demostrar si la estructura es segura completamente.  Por otro lado, si el
estudio establece lo contrario, entonces este edificio debe ser demolido y
los
empleados deben ser relocalizados en otro edificio."dos
