Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: Struck by heavy wire sets causing multiples fractures, severes contusions, lacerations, abrasions, several body trauma and death. a)At the remodeling project located in the Puerto Rico Zoo - Employees were working continually in the process of dismantling some old wire cages, using an innapropiate, unsafe and dangerous method. They placed a couple of slings connected to each wire set of the cages, which were pulled out by a digger instead of use a crane or any other safer equipment to perform such operation. A machine as a digger was designed to work in other types of tasks such as earth movement, perforation trench excavation etc, not to be used for other purposes. Due to the fact that employees performed the process of dismantling on an unsafe way and used an innapropiate equipment to do it, in addition to the lack of employee unknowledge related to the recognition and prevention of hazards at the worksite and the a direct and a continue supervision by the competent person and the lack of hazard evaluation before during and after the operation was completed, an employee suffered an accident when one of the wire sets of one of the cages with measures of 12'6" x 18' with a weight nearly of 350 pounds or more fell down over him when the digger pulled out the wire set aside in a stronger manner causing feebleness in the wire set which hit the employee. The employee was moved to the Mayaguez Medical Center and then to the Rio Piedras Medical Center where he died the next day due to a several body trauma and other complications that he acquired. Location: At the area known as the old monkeys section, where the aviary will be constructed. Among other methods, one feasible and acceptable abatement method to correct this hazard is the using in a safe manner the propper dismantling equipment at the moment of perform this task including a complete training to the employees about the recognition and prevention of hazards at the worksite and a continue supervision of the competent person before, during and after of any operation is performed with a hazard evaluation prior any type of work begins. Ser golpeados por panos de alambres pesados ocasionando multiples fracturas, contusiones severas, laceraciones, abrasiones, severo trauma corporal y muerte. a)En el proyecto en remodelacion localizado en el Zoologico de Puerto Rico - Empleados estuvieron trabajando continuamente en el proceso de desmantelamiento de varias jaulas de alambre viejas, utilizando un metodo inapropiado, inseguro y peligroso. Ellos colocaban un par de cadenas conectadas a cada pano de alambre de las jaulas, las cuales fueron tiradas por una maquina excavadora en vez de utilizar una grua u otro equipo seguro para realizar dicha operacion. Una maquina como una excavadora esta disenada para trabajar en otros tipos de tareas tales como movimiento de tierra, perforacion de excavacion tipo trinchera etc, no para ser utilizada para otros propositos. Debido al hecho de que los empleados realizaron el proceso de desmantelamiento en una manera insegura y utilizaron un equipo inapropiado para hacerlo, ademas de la falta de conocimiento de los empleados relacionado al reconocimiento y prevencion de riesgos en el lugar de trabajo y de supervision continua y directa por la persona competente y la falta de una evaluacion de riesgos antes, durante y despues de que la operacion es completada, un empleado sufrio un accidente cuando uno de los panos de alambre de una de las jaulas con medidas de 12'6" x 18' con un peso aproximado de 350 libras o mas, cayo sobre el cuando la maquina excavadora tiro el pano de alambre de al lado de una manera fuerte ocasionando debilidad en el pano de alambre que le dio al empleado. El empleado fue llevado al Centro Medico de Mayaguez y luego al Centro Medico de Rio Piedras, donde murio el dia siguiente debido al severo trauma corporal y otras complicaciones que adquirio. Localizacion: En el area conocida como la antigua seccion de los monos, donde el aviario va a ser construido. Entre otros metodos, un metodo de correccion factible y aceptable para corregir este riesgo es utilizar de una manera segura el equipo apropiado para desmantelar al momento de realizar esta tarea incluyendo un adiestramiento para los empleados acerca del reconocimiento y la prevencion de riesgos en el lugar de trabajo y una supervision continua de la persona competente antes, durante y despues de que cada operacion es realizada y una evaluacion de riesgos antes de que cualquier tipo de trabajo comience."
