Section 6(a) of the Puerto Rico Occupational Safety and Health Act:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or physical harm to employees
in that employees
were exposed to:
Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico:
El patrono no
proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten
causando o que
puedan causar muerte o dano fisico a los empleados, por cuanto empleados
estaban expuestos
a:
Retching, vomiting, dizziness and ergonomics hazards due to the fact of
walking over an inclinated floor, tripping and falling hazards with the
irregular
tiles and floors causing another injuries such as contusions, lacerations
and
abrasions and death hazard if the structure is submerged or fall down with
employees working inside of it.
a)Employees were working daily and continually inside of a building which
is
actually in settlement.  Such structure have cracked the floors and so many
walls.  This building have a remarkable unlevel floor problem.  The
situation
was reported several times previously to Mr. Cesar Rey and Mr. Edwin
Barreto from OMEP and never was resolved.
Location:  On the Building located at the front area of the school where
the
majority of the classrooms are located.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is remove all employees of the building until a
competent
structural engineer can perform a complete study of the situation and can
demonstrate if the structure is secure completely.  For the other hand if
the
study establish the opposite, then such building must be demolished and the
employees located on another place.
Riesgos de nauseas, vomitos, mareos y ergonomicos debido al hecho de
caminar sobre un piso inclinado, riesgos de tropiezos y caidas con las
losetas y
pisos irregulares ocasionando otras lesiones tales como
contusiones,laceraciones y abrasiones y riesgo de muerte si la estructura
se
hunde o colapsa con los empleados trabajando en su interior.
a)Empleados estuvieron trabajando diaria y continuamente en un edificio el
cual
esta actualmente en asentamiento.  Dicha estructura tiene los pisos y
muchas
paredes rotas.  Este edificio tiene un problema notable de desnivel en el
piso.
La situacion fue reportada varias veces previamente al Sr. Cesar Rey y
Edwin
Barreto de OMEP y nunca fue resuelta.
Localizacion:  En el edificio localizado en el area frontal de la escuela,
donde
la mayoria de los salones de clases estan localizados.Entre otros metodos
un metodo factible y aceptable para corregir este riesgo es
remover a todos los empleados del edificio hasta que un ingeniero
estructural
competente pueda realizar un estudio completo de la situacion y pueda
demostrar si la estructura es completamente segura.  Por otro lado, si el
estudio establece lo contrario, entonces dicho edificio debe ser demolido
y los
empleados deben ser relocalizados en otro lugar."izados
