North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by and/or crushed by excavator bucket: a)on or about May 12, 2001, employees did not stay clear of overhead exposures while working; An employee walked or worked under the bucket of an excavator to attach cables and hooks to lifting eyes on a concrete manhole while the excavator was operating. one feasible means of abatement would be to make sure to never allow personnel to walk or work under any part of the machine while the machine is on and/or operating. b)employer did not follow procedures established by the operator's manual for the JRB coupler to choose a location in the cab to mount the electrical box where the operator can conveniently work the switch and see the light. one feasible means of abatement would be to install the electrical box in a location in the cab in front of the operator, within reach but in an area where the operator would not inadvertently hit the switch.tently
