General-duty citation text

Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause
death or serious physical harm to employees in that employees were exposed
to:
a)  In Department 01, the Caterpillar forklift, #01-3804, did not have a
seat belt.  Employees operating
powered industrial trucks without the use of seat belts were exposed to
the hazard of injury from tip
over accidents which seat belts are designed to address.
Seat belts in forklifts are a component part of an operator restraint
system that is designed to reduce
the incidence and severity of injuries to the operator in the event of a
tip over accident, a hazard to
which forklift trucks are particularly susceptible, and that the failure
to wear the seat belt that is
provided in the forklift increases the risk of injury to the operator in
the event of such an accident.
Among other methods, a feasible and acceptable method to correct this
hazard is to provide a seat belt
as recognized by certain requirements in the more current versions of ANSI
B56.1 consensus standard
for powered industrial trucks; ASME/ANSI B56.1a-1989 Addenda to ASME/ANSI
B56.1-1988, and
ASME B.56.1-1993 - Safety Hazard for Low and High Lift Trucks.
