Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish a place of employment which were free from recognized hazards that
were causing or
likely to cause death or serious physical harm to employees, in that
employees were exposed to
the hazard of falls up to 12 9/10 feet:
Location:  Yonkers Ave. & Central Avenue Yonkers, NY 10701
a) An employee was operating a grinder from an elevated position on the
Himalaya ride, the
employee was approximately 121 inches above ground level without fall
protection.
b) An employee repaired electrical equipment from an elevated position on
the Himalaya ride.
The employee was approximately 12 9/10 feet above ground level without
fall protection.
AMONG OTHER METHODS, TWO FEASIBLE AND ACCEPTABLE ABATEMENT
METHODS TO CORRECT THE HAZARD ARE TO:
1) Develop, implement and enforce a fall protection program.
2) Train employees in the recognition of fall hazards and the use of fall
protection systems.
NOTE: The employer is required to submit abatement certification and
documentation for
this item in accordance with 29 CFR 1903.19.ce
