Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of being struck by the rotating structure of a
Caterpillar 322 BL,
excavator backhoe machine:
a)Job site, West Access Road: One  employee removing lumber from under the
Caterpillar 322 BL, crawler backhoe machine was not protected from being
struck
by the machine, on or about 9/16/02.
Among other methods, One feasible and acceptable abatement method to
correct the hazard is:
1) Follow the safety procedures of the Caterpillar 322BL excavators
Operation and Maintenance
Manual Sebu6940-03. May 1999 issue: (A) Clear all personnel from the
machine
and from area
as described in the manual on page 18, under the topic "Before Operating
Machine",(B) Before
you start the engine and before you move the machine, make sure no one is
underneath the
machine, around the machine, or on the machine. make sure that the area is
free of personnel
as described in the manual on page 18, under "Before Starting The
Machine",(C) When the
machine is moving watch the clearance of the boom as described on page 18,
under "Machine
Operation" and (D) Make sure that no personnel are on the machine or near
the machine in
order to prevent any personal injury as described on page 97 under"Machine
Operation".
2) Follow the safety procedures of the John Deere Dubuque Works,OTM155285
manual, issue
15 where it states on page 5-7 to use a signal person(s) when moving,
swinging, or operating
the excavator in a congested area under "Move and Operate Machine Safely".
NOTE: Because abatement of this violation is already documented in the
inspection
case
file, the employer need not submit certification or documentation of
abatement of this
violation as normally required by 29 CFR 1903.19.
