Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) The hazard of falls in that an employee had to climb on top of a garbage truck to remove debris due to an over-filled dumpster at the top of the front ladder. Among other methods, one feasible and acceptable method is to provide each truck with a hand or foot hold on the truck apron to help prevent slipping that caused fatal injuries to a driver on or about 03-16-02.
